If you do not accept Our Terms, you must not make a booking through the Booking Platform or purchase any products. <\/strong><\/p>\n<\/div>\n\n

Thank you for choosing Yhangry, a great place to book a professional chef experience in your home, accommodation or office.<\/p>\n<\/div>\n\n

\n

Our Terms together with any terms and policies referred to in them constitute a legally binding agreement between you<\/strong>, the Customer<\/strong> and Yhangry Ltd (\u201cYhangry<\/strong>\u201d, \u201cwe<\/strong>\u201d, \u201cus<\/strong>\u201d or \u201cour<\/strong>\u201d). Yhangry is a private limited company registered in England and Wales with company No. 11874670.<\/p>\n<\/div>\n\n

USE OF OUR SITE<\/strong><\/p>\n<\/div>\n\n

Please read our Website and App Terms of Use (\u201cOur Website and App Terms of Use<\/a><\/strong>\u201d) carefully and thoroughly.   By using our Booking Platform, you also agree to comply with Our Website and App Terms of Use. If you do not accept Our Website and App Terms of Use, you must not make a Booking through Yhangry for any Professional Service or purchase any Product.<\/p>\n<\/div>\n\n

YHANGRY\u2019S ROLE<\/strong><\/p>\n<\/div>\n\n

\n

Yhangry provides a booking and purchase service (the \u201cBooking Services<\/strong>\u201d) via our Platform. The Booking Services allow you to book and pay for a range of professional services, including professional chef services (the \u201cProfessional Services<\/strong>\u201d) that are performed in each and every case by independent self-employed professionals (the \u201cIndependent Professionals<\/strong>\u201d).<\/p>\n<\/div>\n\n

\n

Professional Services<\/strong>: The legal implications of the above is that when you purchase Professional Services, it will create two binding legal contracts:<\/p>\n<\/div>\n\n

\n

1. A contract between you (the “Client”) and Yhangry (under which Yhangry has certain responsibilities to you in relation to the booking of Professional Services and the purchase of Products) (the \u201cYhangry Contract<\/strong>\u201d). That contract is made based on our Terms; and<\/p>\n<\/div>\n\n

\n

2. A contract between you and the relevant Independent Professional in respect of the provision or supply of the Professional Services which you book through the Booking Platform (the \u201cProfessional Services Contract<\/a><\/strong>\u201d). The Professional Services Contract is subject to certain provisions of Our Terms including the cancellation policy set out below.<\/p>\n<\/div>\n\n

\n

All Professional Services available for purchase on our Platform are offered by Yhangry on behalf of its Independent Professionals. That is, Yhangry takes and concludes your Booking as a commercial agent for the Independent Professionals. Therefore, we are not responsible or liable to you for the actual Professional Services that are booked through our Platform (including those Professional Services or Products purchased using Yhangry Gift Codes). Yhangry is simply involved with the booking process.<\/p>\n<\/div>\n\n

\n

Our receipt of full payment from you will satisfy your debt to the relevant Independent Professional in respect of that Booking . Though we will assist with certain practical issues on behalf of the relevant Independent Professional, we do not have any contractual obligations to you and you do not have any contractual rights against us regarding any Professional Service provided through us by any Independent Professional.<\/p>\n<\/div>\n\n

Yhangry remains responsible in respect of its obligations to you in accordance with Our Terms, which shall be legally binding. If you have any questions, complaints, or requests for refunds, we can be contacted directly at info@yhangry.com. Yhangry will remain the point of contact for you for customer service questions.<\/p>\n<\/div>\n\n

\n

ELIGIBLE USE<\/strong><\/p>\n<\/div>\n\n

\n

You are not eligible to use the Booking Services if you are under the age of 18.  <\/p>\n<\/div>\n\n

\n

YOUR RIGHTS<\/strong><\/p>\n<\/div>\n\n

\n

As a consumer, you have legal rights in relation to the Professional Services that are not performed with reasonable care and skill or are otherwise not as described through our Booking Platform. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in Our Terms will affect these legal rights.<\/p>\n<\/div>\n\n

\n

BOOKING PROFESSIONAL SERVICES<\/strong><\/p>\n<\/div>\n\n

\n

When you choose an Independent Professsional to cook at your chosen location from our Platform, you make a booking for a particular Professional Service.<\/p>\n<\/div>\n\n

\n

Our booking process allows you to vet the most suitable Independent Professional and check their ratings and reviews before confirming your Booking. Please take the time to read the reviews before finally submitting your Booking. Upon creating the Booking, the Professional Services Contract is made between you and the Independent Professional.<\/p>\n<\/div>\n\n

\n

Your Booking Confirmation is your receipt from Yhangry. Please see the \u2018Prices\u2019 section below in respect of VAT receipts. <\/p>\n<\/div>\n\n

\n

Your payment details will be requested at the time of booking and full payment of the Booking Price is due and will be collected when you make a Booking.<\/p>\n<\/div>\n\n

\n

By making a Booking, you are responsible for:<\/p>\n<\/div>\n\n

\n
    \n
  1. Full payment of the applicable Booking Price;<\/li>\n<\/div>\n\n
    \n
  2. Ensuring the Independent Professional has access to the Designated Premises which must, in all cases, represent a suitable space in which the Professional Service can be performed, with all appropriate facilities (including adequate lighting and heating); and<\/li>\n<\/div>\n\n
    \n
  3. To the extent possible, ensuring the health and safety of the Independent Professional whilst at the Designated Premises.<\/li>\n<\/div><\/ol>\n<\/div>\n\n
    \n

    All Independent Professionals shown on the Platform are subject to availability. The images of the dishes are for illustrative purposes and the final food provided by the Independent Professional may vary from those images.\u00a0<\/p>\n<\/div>\n\n

    \n

    Please note, as set out in our Website Terms & Conditions, we reserve the right to withdraw access to our Website and\/or App and\/or cancel any booking if you fail any credit or fraud prevention check or where we reasonably suspect fraud or money laundering by you or someone using your account.<\/p>\n<\/div>\n\n

    \n

    PRICES<\/strong><\/p>\n<\/div>\n\n

    \n

    You will pay one price to us for the professional services you buy through our Platform (\u201cBooking Price<\/strong>\u201d).\u00a0 We will be responsible for paying the Independent Professional for the Professional Services provided by them (\u201cProfessional Services Fee<\/strong>\u201d).<\/p>\n<\/div>\n\n

    \n

    For the Professional Services, the Booking Price will vary according to the chef, the type of menu, the size of your group, and also the location you have designated for the Professional Service to be provided to you by the Independent Professional (\u201cDesignated Premises<\/strong>\u201d). All prices are as stated on the Booking Platform at the time you book.\u00a0<\/p>\n<\/div>\n\n

    \n

    <\/p>\n<\/div>\n\n

    \n

    The Independent Professional has full responsibility for accounting for any VAT on the total value of the Professional Services they provide, and most Independent Professionals are not VAT registered. We do not charge you VAT on the Professional Services as they are provided by the Independent Professional, not by us.\u00a0 As a result, we cannot provide you with a VAT invoice in respect of your entire Booking but we can on request provide you with a VAT invoice for the 4% Booking Service Fee we charge.<\/p>\n<\/div>\n\n

    \n

    PAYMENT<\/strong><\/p>\n<\/div>\n\n

    \n

    We, as the Independent Professional\u2019s agent, collect or arrange for a third party to collect on our behalf, the Professional Services Fee from you. Our receipt of the Professional Services Fee will be in full payment of the amount due from you to the Independent Professional and Retailer in respect of your Booking.<\/p>\n<\/div>\n\n

    \n

    All amounts are payable through our website via Stripe (or a similar payment facility) (\u201cPayment Facility<\/strong>\u201d). We take reasonable care to ensure that the Payment Facility is available and functioning at all times, but cannot guarantee continuous, uninterrupted or secure access to such Payment Facility, nor can we guarantee that the facility is virus or error free. We use third party payment service providers to process payments and because there are many factors beyond our control (such as delays in the banking system or in card networks), we cannot predict or guarantee the amount of time needed to complete the processing of your payment. Access to the Payment Facility may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. <\/p>\n<\/div>\n\n

    \n

    We will do what we reasonably can to ensure that all of the information you give us when paying for the Professional Service is secure. However, in the absence of negligence on the part of Yhangry, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you may give us at any time.<\/p>\n<\/div>\n\n

    \n

    YOUR RESPONSIBILITIES<\/strong><\/p>\n<\/div>\n\n

    \n

    In addition to other responsibilities set out in Our Terms it is your responsibility to provide complete and accurate information at the time of booking or purchase. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your Booking, an inability of the Independent Professional to provide the Professional Service as requested or an inability of the Retailer to provide the Product. Such failure may also result in loss or incorrect delivery of part of your Booking.<\/p>\n<\/div>\n\n

    \n

    It is your sole responsibility (on your own behalf and that of any other person receiving the Professional Services) to communicate to us in advance any health-related conditions and\/or special needs that might affect the delivery of the Booking or the Professional Services (for example without limitation, allergy information and health issues). If you (or the relevant recipient of the Professional Services) fail to disclose any such information to us or the applicable Independent Professional, neither we nor the relevant Independent Professional shall be liable to you (or the recipient of the Professional Services) for any injury, loss or damages resulting from the Professional Services that could reasonably have been avoided if you (or the recipient of the Professional Services) had disclosed that information prior to receiving the Professional  Services.<\/p>\n<\/div>\n\n

    \n

    When interacting with any Independent Professional you should exercise caution and common sense to protect your personal safety, details and property, just as you would when interacting with other persons who are unknown to you.<\/p>\n<\/div>\n\n

    \n

    CANCELLING A BOOKING<\/strong><\/p>\n<\/div>\n\n

    \n

    You acknowledge that you may or may not have a statutory right to cancel a booking made for a Professional Service or Product. However, you have a contractual entitlement to cancel any booking you have made with an Independent Professional through us in the circumstances set out below.\u00a0<\/p>\n<\/div>\n\n

    \n

    If you change your mind about your booking for the Independent Professional prior to the agreed start time of that booking (the \u201cBooking Time<\/strong>\u201d) then you may cancel your Booking and obtain a full refund of the \u201cService Price<\/strong>\u201d (being the Booking Price less any Product Price you paid) if you cancel via our website:<\/p>\n<\/div>\n\n

    \n
      \n
    1. At least seven days (or 168 hours) prior to the Booking Time; or<\/li>\n<\/div>\n\n
      \n
    2. If the cancellation time falls within ten (10) minutes of placing a Booking (the \u201cGrace Period<\/strong>\u201d).<\/li>\n<\/div><\/ol>\n<\/div>\n\n
      \n

      If you cancel a booking:<\/p>\n<\/div>\n\n

      \n
        \n
      1. Within 7 days (or 168 hours) prior to the Booking Time; or<\/li>\n<\/div>\n\n
        \n
      2. After the Grace Period has elapsed,<\/li>\n<\/div><\/ol>\n<\/div>\n\n
        \n

        Then we will be entitled to retain one hundred per cent (100%) of the Booking Price as Cancellation Fee.<\/p>\n<\/div>\n\n

        \n

        We will also be entitled to retain the Cancellation Fee if you:<\/p>\n<\/div>\n\n

        \n
          \n
        1. Cancel a booking other than as permitted above; <\/li>\n<\/div>\n\n
          \n
        2. Fail to attend the delivery of the Professional Services at the Booking Time at the Designated Premises.<\/li>\n<\/div><\/ol>\n<\/div>\n\n
          \n

          A Cancellation Fee is charged in order to compensate the Independent Professional because it is not reasonable to expect the Independent Professional to be able to provide a Professional Service at another booking where you cancel with short or no notice.<\/p>\n<\/div>\n\n

          \n

          Where a Cancellation Fee applies but you need to cancel a booking for genuine reasons which are outside of your control, including for example if a guest is unwell, we may in our absolute discretion either waive some or all of the Cancellation Fee and give you a full or partial refund, or issue you a voucher to be used against a future booking with us. Where Cancellation Fees are waived by us, we act as an agent of the Independent Professional who is the principal in supplying the Professional Service.<\/p>\n<\/div>\n\n

          \n

          Refunds: <\/strong>Any refund due to you will be processed as soon as possible. Refunds are made using the same method originally used by you to pay for your purchase and appear on your statement usually within 5-10 business days.<\/p>\n<\/div>\n\n

          \n

          The above does not apply to peak day bookings (Christmas Day, Boxing Day, New Years\u2019 Eve and any other day or period that we may include from time to time). They are subject to their own cancellation policy, e.g. there is no refund for Christmas Day bookings.<\/p>\n<\/div>\n\n

          \n

          DISCOUNT CODES AND REFERRALS<\/strong><\/p>\n<\/div>\n\n

          \n

          We may from time to time create and offer promotional codes and referral codes (together the \u201cCodes<\/strong>\u201d) that can be redeemed against purchases of Professional Services. Codes will only be valid for a period of time stated on or with them.<\/p>\n<\/div>\n\n

          \n

          Codes do not have any cash value. Codes may:<\/p>\n<\/div>\n\n

          \n
            \n
          1. Only be used for personal and non-commercial purposes. You can share your unique code with your personal connections via social media where you are the primary content owner. Codes may not be duplicated, sold, transferred, distributed or made available to others online (including through public site such as coupon sites) or by other means;<\/li>\n<\/div>\n\n
            \n
          2. Not be promoted in any way including via a search engine;<\/li>\n<\/div>\n\n
            \n
          3. Not be exchanged for cash;<\/li>\n<\/div>\n\n
            \n
          4. Only be used once and only one Code may be used per person; and<\/li>\n<\/div>\n\n
            \n
          5. May be subject to specific terms which will be made available by us and must only be used in accordance with those terms.<\/li>\n<\/div><\/ol>\n<\/div>\n\n
            \n

            In addition, from time to time we may issue referral Codes to allow you to refer friends and family to the Professional Services.<\/p>\n<\/div>\n\n

            \n

            Discounts cannot be used in conjunction with any other offers or discounts.<\/p>\n<\/div>\n\n

            \n

            INTELLECTUAL PROPERTY<\/strong><\/p>\n<\/div>\n\n

            \n

            Yhangry, the Yhangry logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with the Booking Platform, the Booking, the Products and \/or the Professional Services (whether registered or unregistered) belong to us or our licensors and are protected by intellectual property law. Nothing in Our Terms grants you any rights in any of the above.<\/p>\n<\/div>\n\n

            \n

            RESOLVING ISSUES<\/strong><\/p>\n<\/div>\n\n

            \n

            As we are an introducer, we are not liable or responsible for the fulfilment of any booking or the performance of the Independent Professional. You acknowledge and agree that we are not responsible for addressing any claims you have as regards any Independent Professional or any Professional Services, however we do try to assist by providing the intermediary services around resolving disputes and complaints.<\/p>\n<\/div>\n\n

            \n

            We care about your experience and want to ensure we maintain the highest standards possible and so if you would like to make a complaint about one of our Independent Professional or their Professional Services, please either:<\/p>\n<\/div>\n\n

            \n
              \n
            1. Speak to the Independent Professional yourself to try and resolve the issue; and\/or<\/li>\n<\/div>\n\n
              \n
            2. Contact us on info@yhangry.com before 12 PM the day after the event, and we will do our best to help. If we are not made aware of any issues before this time, we will consider this as a statement from you that the services carried out were acceptable. The Professional Service Fee is released to our chefs within 48 hours of the event, usually the day after. If your complaint does not reach us by 12 PM the day after your event we will have paid the Independent Professional and it will be harder to resolve your dispute.<\/li>\n<\/div><\/ol>\n<\/div>\n\n
              \n

              Following receipt of a complaint we will contact the Independent Professional to try and resolve the issue on your behalf. If we are unable to resolve the issue following contact with the Independent Professional, if we consider it to be fair in all the circumstances, we may at our sole discretion elect to:<\/p>\n<\/div>\n\n

              \n
                \n
              1. Give you a credit note for the disputed\/complained about the amount of your booking, which you can redeem on the Platform to reduce the purchase price of any future Booking.<\/li>\n<\/div><\/ol>\n<\/div>\n\n
                \n

                IMPORTANT NOTE: PLEASE DO BEAR IN MIND THAT WHILE WE TAKE ALL COMPLAINTS ABOUT OUR INDEPENDENT PROFESSIONALS VERY SERIOUSLY AND WILL ALWAYS DO WHAT WE CAN TO HELP TO RESOLVE THEM, WE ARE NOT RESPONSIBLE TO YOU FOR THE PROFESSIONAL SERVICES WHICH THE INDEPENDENT PROFESSIONALS PROVIDE AND WE ARE UNDER NO OBLIGATION TO PROVIDE YOU WITH A REFUND OR CREDIT NOTE IN THE EVENT YOU ARE DISSATISFIED WITH THE PROFESSIONAL SERVICES WHICH YOU HAVE RECEIVED FROM THE INDEPENDENT PROFESSIONALS.<\/strong><\/p>\n<\/div>\n\n

                LIABILITY<\/strong><\/p>\n<\/div>\n\n

                \n

                As noted above, we introduce individuals seeking Professional Services from Independent Professionals intending to provide such Professional Services and sell certain related Products on behalf of Retailers. We are not liable or responsible for the fulfilment of any booking, the performance of the Independent Professional or the delivery of any Product. <\/p>\n<\/div>\n\n

                \n

                WHEN ONBOARDING INDEPENDENT PROFESSIONALS, WE ASSESS THEM FOR THEIR SUITABILITY FOR OUR PLATFORM. THIS INCLUDES ASSESSING THEIR EXPERIENCE AND ENSURING THEY HAVE A CERTIFICATE OF HYGIENE AWARENESS.\u00a0 HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT WE DO NOT GUARANTEE OR WARRANT, AND MAKE NO REPRESENTATIONS REGARDING THE RELIABILITY, QUALITY OR SUITABILITY OF THE INDEPENDENT PROFESSIONALS AND HAVE NO OBLIGATION IN RESPECT OF ANY PROFESSIONAL SERVICE THEY MAY PROVIDE.<\/strong>.<\/p>\n<\/div>\n\n

                NOTHING IN OUR TERMS WILL EXCLUDE OR LIMIT ANY WARRANTY IMPLIED BY LAW THAT IT WOULD BE UNLAWFUL TO EXCLUDE OR LIMIT AND NOTHING IN OUR TERMS WILL EXCLUDE OR LIMIT OUR LIABILITY IN RESPECT OF ANY: DEATH OR PERSONAL INJURY CAUSED BY THE NEGLIGENCE OF YHANGRY, FRAUD OR FRAUDULENT MISREPRESENTATION BY YHANGRY, OR ANY MATTER WHICH IT WOULD BE ILLEGAL OR UNLAWFUL FOR YHANGRY TO EXCLUDE OR LIMIT, OR TO ATTEMPT OR PURPORT TO EXCLUDE OR LIMIT, ITS LIABILITY.<\/strong><\/p>\n<\/div>\n\n

                WE ARE NOT LIABLE OR RESPONSIBLE FOR ANY ERRORS IN OR FAILURE TO PROVIDE THE PROFESSIONAL SERVICES DUE TO YOUR ERROR OR FAILURE TO PROVIDE ACCURATE AND COMPLETE INFORMATION. <\/strong><\/p>\n<\/div>\n\n

                WHERE WE HAVE BEEN NEGLIGENT AND\/OR BREACHED A CONTRACTUAL OBLIGATION TO YOU, WE WILL BE LIABLE FOR ANY LOSS OR DAMAGE YOU SUFFER AS A RESULT, PROVIDED THAT LOSS AND\/OR DAMAGE IS FORESEEABLE. LOSS OR DAMAGE IS FORESEEABLE IF IT IS AN OBVIOUS CONSEQUENCE OF OUR NEGLIGENCE OR BREACH OF CONTRACT OR WOULD HAVE BEEN CONSIDERED BY YOU AND US TO BE A LIKELY CONSEQUENCE OF IT AT THE TIME YOU ENTERED INTO OUR TERMS. <\/strong><\/p>\n<\/div>\n\n

                WE DO NOT ACCEPT ANY LIABILITY FOR THE FOLLOWING TYPES OF LOSS, WHETHER CAUSED BY BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF THE LOSS IS FORESEEABLE: LOSS OF INCOME OR REVENUE; LOSS OF BUSINESS; LOSS OF PROFITS; LOSS OF ANTICIPATED SAVINGS; OR WASTE OF MANAGEMENT OR OFFICE TIME.<\/strong><\/p>\n<\/div>\n\n

                WE WILL NOT BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE, COST OR EXPENSE YOU MAY INCUR THAT ARISES FROM OR RELATES TO:<\/strong><\/p>\n<\/div>\n\n

                1. YOUR USE OR MISUSE OF THE BOOKING SERVICES; <\/strong><\/li>\n<\/div>\n\n

                2. YOUR USE OR MISUSE OF THE PROFESSIONAL SERVICES.<\/strong><\/li>\n<\/div><\/ol>\n<\/div>\n\n
                  \n

                  CHANGES TO THESE TERMS AND TERMINATION<\/strong><\/p>\n<\/div>\n\n

                  \n

                  We may modify Our Terms or terminate use of the Booking Services or Professional Services at any time by giving notice to you. Every time you wish to make a booking on the Booking Platform, please check Our Terms to ensure you understand the terms which will apply at that time. If you do not agree to any changes, you must stop using the Booking Services or Professional Services. We may also change, suspend, terminate or discontinue any aspect of the Booking Services or Professional Services including availability of certain features at any time for any reason.<\/p>\n<\/div>\n\n

                  GENERAL<\/strong><\/p>\n<\/div>\n\n

                  \n

                  All communications and notices from you must be sent to info@yhangry.com<\/a>. We may communicate and give notice to you via email or by posting notices on the Booking Platform.<\/p>\n<\/div>\n\n

                  \n

                  Our customer support hours are: 9 AM – 6 PM Monday to Sunday and Bank Holidays. <\/p>\n<\/div>\n\n

                  \n

                  We reserve the right to deactivate your account in the event of a breach of Our Terms and\/or where you act in a way that is inappropriate, abusive or otherwise unacceptable towards us or an Independent Professional, either in communications via phone or email, or in person.<\/p>\n<\/div>\n\n

                  \n

                  If any provision of Our Terms is deemed or becomes invalid, the validity of the other provisions shall not be affected.<\/p>\n<\/div>\n\n

                  \n

                  You agree that Our Terms for all purposes shall be governed by and construed in accordance with English law. You also agree to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under Our Terms.<\/p>\n<\/div>\n\n

                  \n
